    Ordered 1894 .44 from dealer. Showed up a few days later, opened the box and it looked good. Took it home, lowered the lever for the first time and the lever stuck in the down position. The bolt is so far out of spec that it isn't even close to locking the hammer back. The bolt will not close on an unlocked hammer. The only way to close the bolt is to reach under the the bolt to push the hammer to lock back by hand. How did this obvious defect leave the factory? The loading gate has brass marks so it must have been test fired. Who ever did the test fire had to reach under the bolt and cock the hammer to close the bolt after test fire. Lessons learned. 1. Look over a new Marlin as if it an abused used gun. 2.The quality control is non existent. 3. Also was told by Marlin that not all rifles are test fired. I deeply regret having my money tied up in a defective rifle that I can't use and no lo,get want. My Rossi 92 .357 has been a flawless shooter as is my old .300 Savage 99. Was looking for a .44 mag lever gun with a side loading gate. Very upset😠

    I thought all rifles made in the USA had to be test fired with two proof loads before the proofmark can legally be applied. I've always been under the impression that this is Federal Law.

    Had the same problem with an 1894 44 mag. The problem was not the bolt but the hammer. It was cut incorrectly. Tired of dealing with Remington so I bought a replacement hammer from Numrich and all is well.

    There are many of us, on this forum, that will not buy a Marlin unless it is a New Haven made JM stamped one.
    I have yet to find a post Freedom Group take over Marlin rifle, that I would want to own.
    Your best bet is to try the dealer first. Maybe he could get it exchanged or refund your money.
    Second choice is to send it back to Marlin and see if they will fix the issue.
    Third is to take it to a qualified smith and get it fixed.

    Remlin (new Marlin) have been (and still) known to have quality issues. Check out the "rant section".. lots to read about on new Marlins with problems.

    I agree with alawrence. Being that you just brought it and haven't even been able to shoot it, I would take it back to the retailer and request a refund or exchange (I would prefer a refund.)

    Would have liked to buy an older Marlin. Unfortunately used lever actions are rarely seen in this area.

    What is the production date code? It is located on the left rear of barrel near the receiver, a two letter stamp.

    Don't know the date code. Dealer shipped the rifle out less than an hour after I picked it up.

    I feel your pain, been there, done that with other products. If your dealer gave you a good price I also feel bad for him. Shipping it right back tells me he's a stand up guy. Good luck. In my opinion if it comes back and isn't nearly perfect I'd demand a refund and look for a Jenewehine JM Marlin. They are out there and can be had for what you paid for the lemon.
